Judgment
The matter has been heard through video conferencing with the consent of the learned counsel for the parties. They have no complaint about any
audio and visual connectivity.
The instant civil misc. petition has been filed for restoration of W.P.(C) No.5969 of 2018 to its original file which stood dismissed for nonprosecution
on 11.10.2019.
The other side has been represented by Mr. R. K. Saha, learned counsel for the opposite parties.
Learned counsel for the petitioner has submitted that the writ petition being W.P.(C) No.5969 of 2018 has been dismissed for non-prosecution on
11.10.2019.
Mr. R. K. Saha, learned counsel for the opposite parties has raised no objection rather he has fairly submitted that the writ petition may be restored to
its original file so that the matter may be heard and decided on merit.
This Court, after having heard the learned counsel for the parties and considering the submissions advanced on their behalf and reason assigned in the
petition, deem it fit and proper to restore the writ petition being W.P.(C) No.5969 of 2018 to its original file.
In view thereof, the writ petition being W.P.(C) No.5969 of 2018 is restored to its original file.
In the result, the instant civil misc. petition stands disposed of.
Learned counsel for the petitioner undertakes to remove the defects within three weeks from today.
