Heard the Parties.

The petitioner is apprehending his arrest in connection with Manjhari P.S. Case No.30 of 2023, for the offences under Sections 379/411 of the Indian Penal Code, pending in the court of learned Sub Divisional Judicial Magistrate (Sadar) West Singhbhum at Chaibasa.

On 06.07.2023, Manjhari police apprehended three persons from a place near Lankasai Tola pound. On search large number of stolen batteries were recovered from their possession. The apprehended accused persons spelt out the name of this petitioner that he was also present at the place of occurrence and fled away on seeing the police party.

Learned lawyer for the petitioner submitted that similarly situated co-accused has been granted regular bail vide B.A. No. 8142 of 2023. It was further submitted that apart from confession of co-accused there is no other material against them.

Learned A.P.P. has opposed the prayer for anticipatory bail of the petitioner but has conceded the aforesaid facts.

Regard being had to the facts and circumstance of the case; I am inclined to extend the privilege of Anticipatory Bail to the petitioner. He is directed to surrender before the court below within two weeks from the date of receipt of copy of this order and learned court below on his surrender shall release him on bail on furnishing bail bond of Rs. 25,000/- (Twenty five Thousand only) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate (Sadar) West Singhbhum at Chaibasa in connection with Manjhari P.S. Case No.30 of 2023, Subject to the conditions as laid down under Section 438 (2) Cr.P.C.
