Petitioner has applied for a regular permit in respect of a suitable vehicle, operating on the route Vyttila Hub-North Paravoor. The said application which was submitted on 10.1.2021, was considered by the 1st respondent, The Regional Transport Authority, in its meeting held on 28.10.2021 and regular permit was granted subject to settlement of timings and production of Registration Certificate, within the time stipulated under Rule 159 of the Kerala Motor Vehicle Rules. Pursuant to the grant of regular permit to the petitioner vide Ext.P1, petitioner submitted Ext.P3 request along with the Registration Certificate of State Carriage No.KL-7/AR-8818. Thereafter petitioner submitted Ext.P4 request for settlement of timings and issuance of regular permit. Along with Ext.P4 application, petitioner had also produced entire records including fitness certificate and Registration Certificate. Based on Ext.P3 request, 1st respondent granted maximum time of four months. Since the petitioner had already produced the records before the 2nd respondent, the 2nd respondent is bound to settle the timings and issue regular permit to the petitioner. Accordingly, petitioner submitted Ext.P7 request. The grievance of the petitioner is that in spite of production of Registration Certificate and fitness certificate and other records, the request made by the petitioner for settlement of timings and issuance of regular permit is not considered by the 2nd respondent.

Heard the learned counsel for the petitioner and the learned Government Pleader for the respondent.

The learned Government Pleader, on instructions, submits that a meeting is scheduled to be convened on 2.8.2022 and Ext.P7 request of the petitioner for issuance of regular permit in respect of his State Carriage No.KL-7/AR-8818 will be considered in the said meeting. The said submission of the learned Government Pleader is recorded.

Having heard the submissions on either sides, there will be a direction to the 2nd respondent to settle the timings and issue regular permit to the petitioner to operate his State Carriage bearing No.KL-7/AR-8818 on the route Vyttila Hub-North Paravoor, in accordance with law, in the meeting scheduled to be held on 2.8.2022.

Writ petition stands disposed of as above.
