Rule returnable forthwith. Learned APP waives service of notice of Rule for and on behalf of the respondent-State.
Heard learned advocate for the applicant as well as learned APP for the respondent-State.
It was submitted by learned advocate for the appilcant that due to typographical error incorrect FIR number came to be typed which came to be typed
as C.R.No.I-11209018200041 of 2020. It is submitted that as a typographical error has been cropped up in mentioning the FIR number, even in cause
title of the memo of Criminal Misc. Application No.11188 of 2020 incorrect number came to be typed out and therefore, the applicant preferred
speaking to minutes, however, the same was not came to be entertained, present application is preferred and it is prayed that this Court may kindly
pass appropriate order for releasing the applicant in connection with the correct FIR number being C.R.No.I- 11209028200041/2020 dated 21/01/2020
and applicant may kindly be released on bail in connection with the correct number of the FIR for the offences punishable under Sections 396, 397,
302 and 120(B) of the Indian Penal Code, under Section 25(1-B-A) and 27 of the Arms Act, under Section 135 of the Gujarat Police Act and as well
as for the offences punishable under Sections 323, 302 and 114 of the Indian Penal Code.
Learned APP for the respondent-State has requested to pass necessary orders.
Having heard learned advocate for the applicant as well as learned APP, in order dated 17.12.2020 passed by this Court in Criminal Misc. Application
No.11188 of 2020, third line of at Page-1, last line of Page-2 and fifteen line of Page-4, C.R. number shall be corrected and read as ""C.R.No.I-
11209028200041 of 2020"" and Sections 323, 302 and 114 of the Indian Penal Code shall be added prior to wording ""Sections 25(1-b)(a) and 27
of the Arms Act"" in line no.5 at Page-1 and line no.2 at Page-3.
With the aforesaid direction, present application stands allowed and accordingly disposed of. Rule is made absolute accordingly.
