This Writ Petition is filed seeking a writ of mandamus, declaring the action of the respondents in preventing the petitioner to travel abroad i.e., Doha (Qatar) holding Passport bearing No.P6216289 by Indigo Airways on 15-04-2022 from Shamshabad International Airport without issuing any prior notice or intimation, as illegal, arbitrary and consequently direct the respondents to permit the petitioner to travel Doha (Qatar) on or before 09-05-2022 and return to India as and when required by the concerned Court in connection with Crime No.6 of 2022 pending on the file of WPS, Nizamabad.

Heard Sri P. Ravinder Reddy, learned counsel for the petitioner and Sri B. Jithender, learned Standing Counsel for Central Government. Perused the record.

Learned counsel for the petitioner submitted that the petitioner was stopped at Rajeev Gandhi International Airport on 15-04-2022 while leaving to Doha (Qatar). On questioning as to why he was prevented to travel, they informed that LOC was issued and it was pending against him for the reason of a Crime being registered under Section 498-A of IPC vide Crime No.06 of 2022 pending on the file of WPS, Nizamabad. Learned counsel for the petitioner further submits that the VISA is going to expire and requested this Court to grant permission to travel.

Learned counsel for the respondents submits that in fact there are no instructions. However, petitioner can be directed to file an appropriate application before the concerned Magistrate Court for the purpose of travel.

Accordingly, this writ petition is disposed of grating liberty to the petitioner herein to move an appropriate application before the I Addl. Judicial Magistrate of First Class Court, Nizamabad, seeking permission to travel abroad and learned Magistrate is directed to dispose of the said application within two (2) working days.

Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
