Judgment
Sri Mohammed Shaffiq, learned Counsel appearing for the appellant and Sri Vikram Huilgol, learned HCGP appearing for the respondents jointly submit that the writ appeal may be disposed of in the following terms:
The appellant shall deposit Rs.1,00,00,000/- (Rupees One Crore Only) with respondent No.2-Deputy Commissioner of Commercial Taxes, Mangaluru, within two weeks from today and within one week from such deposit, respondent Nos.1 and 2 will enable the appellant to download ''C'' forms relating to the turnover of Rs.7.12 crores pertaining to the assessment years 2011-2012, 2012-2013 and 2013-2014.
In view of the above, we make the following order:
The appellant shall deposit Rs.1,00,00,000/- (Rupees One Crore only) with respondent No.2 within two weeks from today. Within one week from such deposit, respondent Nos.1 and 2 shall enable the appellant to download ''C'' forms relating to the aforesaid turnover pertaining to the assessment years 2011-2012, 2012-2013 and 2013-2014. This shall be subject to the assessment orders to be passed in the matter.
The writ appeal is disposed of in the above terms in modification of the order of the learned Single Judge which is impugned in this appeal. In view of disposal of the appeal, IA No.2/2017 does not survive for consideration; it stands disposed of accordingly.
