Judgment
The present writ petition is taken up today through Video conferencing.
The present writ petition has been filed for the following reliefs :- a. For quashing the impugned tender cancellation notice dated 30th May, 2020 and the Government Electronic Procurement Notification dated 1st June, 2020 got issued by the Director of RIMS, Ranchi.
b. For issuance of a direction upon the respondents to re- open the price bids and finalize the tender being NIT No.832 dated 28th February, 2019 as submitted by the concerned authorities through their learned advocate at the time of hearing of W.P.(C) No.427 of 2020 and recorded in the order dated 3rd March, 2020 before this Court.
c. For issuance of direction upon the respondents to cancel and/or revoke the intimation of revocation of tender dated 31st March, 2020 including any informal decision if any taken and all consequential orders arising therefrom and to act in accordance with law.
d. For prohibiting the respondents and each one of them from giving any effect or further effect and/or to act in furtherance to the impugned tender cancellation notice dated 30th May, 2020 and the government electronic procurement notification dated 1st June, 2020 issued by the Director, RIMS, Ranchi till disposal of the writ petition. e. Ad-interim order of injunction restraining the respondents and each one of them, their men agents and/or subordinates from giving effect or further effect and/or acting in furtherance to the impugned tender cancellation notice dated 30th May, 2020 and the government electronic procurement notification dated 1st June, 2020 issued by the Director, RIMS, Ranchi till disposal of the writ petition.
Learned counsel for the petitioner submits that during pendency of the writ petition a new tender being Tender Notice No.RIMS/Kitchen Stores (8)/3382 dated 16th September, 2020 has been floated by Rajendra Institute of Medical Science, Ranchi in which the petitioner has also participated. The technical bids of tenderers are presently being evaluated. Under the aforesaid development, he seeks permission of this Court to withdraw the present writ petition.
Mrs. Pinky Tewari, learned A.C. to A.G. appearing on behalf of the respondent nos.1 and 2 as well as Mr. Akash Deep, learned A.C. to Dr. Ashok Kumar Singh, Advocate appearing on behalf of the respondent nos.3 to 5 have no objection to the same.
Permission is accorded.
The present writ petition is dismissed as withdrawn. I.A. No.5240 of 2020 stands dismissed accordingly.
