Heard Mr. Nabin Kumar, learned counsel appearing for the petitioner; Mr. S.S. Kashyap, learned Central Government Counsel appearing for opposite parties no.1 & 5 and Mr. P.P. Mohanty, learned Additional Government Advocate appearing for the State-opposite parties.

Mr. Nabin Kumar, learned counsel appearing for the petitioner, at the outset, vehemently contended that the Deputy Director of Mines, Joda Circle, Keonjhar, vide order dated 01.02.2023 issued notice to the petitioner demanding a sum of Rs.1,02,22,362/- towards differential premium value determined from July, 2022 to September, 2022 in respect of Jaribahal Iron Block under Champua Sub-division of Keonjhar District. It is contended that such demand has been raised without giving any opportunity of hearing to the petitioner. Apart from the same, the petitioner challenged the said order before this Court by filing W.P.(C) No.31670 of 2023, which was withdrawn with liberty to the petitioner to file a fresh writ petition with better particulars. Since there was availability of alternative remedy, the petitioner filed Revision Application No.22/(17)/2023/RC-1 before the Revisional Authority challenging the demand notice issued by the authority on various grounds. But, the Revisional Authority, without taking into consideration the grounds no. D, E, F and G, in a very casual manner has dismissed the revision petition of the petitioner under Annexure-2 dated 18.09.2023. Therefore, the petitioner has approached this Court by filing this writ petition.

Since Mr. S.S. Kashyap, learned Central Government Counsel accepts notice on behalf of opposite parties no.1 & 5, let two extra copies of the brief be served on him within three days to enable him to obtain instructions or file counter affidavit.

Since Mr. P.P. Mohanty, learned Additional Government Advocate accepts notice on behalf of opposite parties no.2 to 4, let three extra copies of the writ petition be served on him within three days to enable him to obtain instructions or file counter affidavit.
