This hearing has been conducted through hybrid mode.
The present petition has been filed by the petitioner under Article 227 of the Constitution of India, 1950, assailing the order dated 30th January, 2024 passed by the learned Trial Court in case bearing No. DJ CS 151/2018, with the following prayers:
“a.Allow the present Petition of Petitioner/Defendant No. 1 against the impugned order dated 30.01.2024 passed by the Ld. Abhitosh Pratap Singh Rathore, Additional District Judge, South District, Saket Courts, New Delhi in suit bearing No. DJ CS 151/2018 may kindly be look into in the interest of justice.”
Heard. Record perused.
At the outset, learned Counsel for the respondent submitted that the respondent has no objection if the present petition is allowed and the PW-1 be cross examined, subject to payment of exemplary costs.
In view of the submissions made by the learned Counsel for the respondent, the petitioner is allowed to cross-examine PW1, subject to payment of costs of Rs. 10,000/- to the respondent.
It shall be open to the learned Trial Court to allow the cross-examination of PW1 on the date already fixed or on any other date convenient to the learned Trial Court.
Accordingly, the present petition is disposed of in the above-stated terms. Pending application(s), if any, also stands disposed of.
