Present Mr.N.Jotendro, learned senior counsel assisted by Mr.Abdul Baqee Khan, learned counsel for the petitioner, Mr.Pamchui, learned counsel for respondent No.1, Mr.S.Niranjan, learned Government Advocate for respondent No.2. None appears on behalf of respondent Nos.3 and 4 and Mr.Satyajit, learned counsel appears on behalf of SBI, Manipur University Branch.
The Current Account of the petitioner bearing No.38251849894 opened in the State Bank of India, Manipur University Campus Branch has been kept on hold on the complaint made by respondent Nos.3 and 4 for alleged disputed transaction of Rs.1 lakh on 11.10.2024.
It is stated that the petitioner has no knowledge about the transaction and his account has been misused by a third party and the current account of the petitioner has been kept on hold due to the alleged transaction of disputed amount of Rs.1 lakh.
None of the respondents have filed counter affidavit as on date. Mr.N.Jotendro, learned senior counsel for the petitioner, on instruction submits that the petitioner is facing difficulty as his current account cannot be operated and an interim prayer is made that during pendency of the present petition, the current account of the petitioner may be operational by lifting the kept on hold and keeping lien of disputed amount of Rs.1 lakh.
Learned counsel for the respondents submit that this Court may pass appropriate order.
Considering the peculiar facts of the case, this Court is of the view that the matter will take some time for final disposal as counter affidavit has not been filed. The impugned order of keeping on hold the current account of the petitioner, affects business transaction of the petitioner and in the circumstance, respondent No.5, State Bank of India, Manipur University Branch is directed to lift the order of kept on hold to current account bearing No.38251849894 of the petitioner by keeping lien of disputed sum of Rs.1 lakh, during pendency of the present petition.
