The petitioner has filed this writ petition challenging Ext.P6 order passed by the 1st respondent.

A statement has been filed on behalf of the 2nd respondent stating that the petitioner has an alternative remedy by way of an appeal under Section 39 of the Kerala General Sales Tax Act, 1963 (for short, ‘the Act’) against Ext.P6.

The learned counsel for the petitioner submits that the petitioner will prefer an appeal along with stay petition invoking the provisions under Section 39 of the Act within a period of one month.

In case the petitioner prefers such an appeal along with stay petition within a period of one month from today, the same shall be entertained by the appellate authority and orders on stay petition shall be passed expeditiously and in accordance with law. Till such time, the stay petition is considered and orders passed, there will be a stay of all further proceedings pursuant to Ext.P6.

The writ petition is disposed of with the above direction.
