This writ petition has been filed by M/s Uttaranchal Iron and Ispat Ltd., which is registered as a Company under the Companies Act. The reliefs

sought in the writ petition are as follows:

“I. To issue a writ, order or direction in the nature of certiorari to quash the order dated 10.2.2021 (annexure no.

1) passed by the respondent no. 5 herein/The Electricity Ombudsman Uttarakhand in Representation no. 24 of 2020 “M/s Uttaranchal Iron and

Ispat Ltd. v/s Managing Director UPCL and others†and further to quash the order dated 25.8.2020 (annexure no.2) passed by the respondent no. 4

herein/Electricity Consumer Grievance Redressal Forum in Complaint no. 20 of 2019-20 “M/s Uttaranchal Iron and Ispat Ltd. v/s Uttarakhand

Power Corporation Ltd. (UPCL) and two others.

II. To issue a writ, order or direction in the nature of mandamus commanding the respondent no. 1 to 3 to reduce the disputed amount charged by the

respondent no. 1 to 3 under the heading Fixed charges/Demand charges for Contr. Load from the electricity bill raised for the months September,

2016, October, 2016, March, 2017, April, 2017, May, 2017, June, 2017, July, 2017 & August 2017 whereby the electricity connection of the petitioner

Company remained disconnected.â€​

Mr. Vishal Dixit, learned counsel appearing for the petitioner in connected writ petition submits that, in view of the reliefs claimed in WPMS No.

1012 of 2021, the reliefs sought in this writ petition do not survive.

Since in WPMS No. 1012 of 2021, petitioner has sought a direction to U.P.C.L. to accept the entire dues upto the filing of the said writ petition in

12 equal bimonthly installments from the petitioner, Mr. Vishal Dixit, Advocate submits that petitioner admits his liability to pay the entire dues and

does not wish to challenge the order passed by Electricity Ombudsman, Uttarakhand, which is impugned in the present writ petition.

This Court finds substance in the contention raised by Mr. Vishal Dixit, Advocate.

In view of the reliefs claimed in WPMS No. 1012 of 2021, the reliefs, as claimed in the present writ petition, do not survive, as it amounts to

admission on the part of the petitioner to pay his entire liability towards electricity charges.

In such view of the matter, the writ petition is dismissed as infructuous.
