The applicant herein was appointed as Driver/HMV under the respondent-NDMC on 25.11.1980. He was superannuated on 31.07.2009. The
applicant is aggrieved with the pay fixation order issued on 06.10.2020 and apprehended that certain recoveries will be made on the basis of this pay
fixation order. The applicant has already preferred a representation on 06.11.2020, which has not been decided as yet. Apprehending recovery, he has
approached the Tribunal by filing the instant OA.
Issue notice to the respondents. Ms. Sriparna Chatterjee, learned counsel, who appears on behalf of respondents on advance service, accepts
notice.
Shri Bhasin, learned counsel for the applicant, at this stage, submits that the applicant will be satisfied, if the present OA is disposed of with
direction to the respondents to consider his aforesaid representation dated 06.11.2020 (Annexure-A1) and to dispose of the same in a time bound
manner.
We have heard the learned counsel for the parties.
We are of the considered view that if such request of the applicant is accepted, no prejudice is likely to be caused to the respondents.
In view of the aforesaid, without going into the merits of the claim of the applicant, the present O.A. is disposed of with direction to the respondents
to consider the applicant’s aforesaid representation dated 06.11.2020 (Annexure-A1) and to dispose of the same by passing a reasoned and
speaking order as expeditiously as possible and in any case within eight weeks from the date of receipt of a copy of this order. It is further directed
that till disposal of the said representation the respondents will not give effect to the impugned order dated 06.10.2020.
The O.A. is disposed of, in the aforesaid terms. However, in the facts and circumstances, there shall be no order as to costs.
