Judgment
A counter affidavit has been filed by the Block Development Officer (BDO), Bahanaga, Dist-Balasore enclosing copy of the letter issued to the Assistant Executive Engineer, Panchayati Raj Department to stop the construction work at the site in question. Both the Collector, Balasore and the BDO, Bahanaga are present online.
Learned counsel for the Petitioner has filed yet another additional affidavit dated 10th April, 2023 enclosing some photographs, three of which have been taken on 23rd March and four on 29th March, 2023 stating that the construction work is still going on. The Collector, Balasore present online has assured this Court that the interim order passed by him staying further construction activity is in fact being enforced and he has given an assurance that his interim orders will be strictly implemented.
Learned counsel for the Petitioner confirms that he has received the copies of the Collector’s order as directed by this Court on 29th March, 2023.
In view of the assurance given by the Collector, Balasore before the Court today, no further directions are called for at this stage. The writ petition is accordingly disposed of.
