Sudhanshu Dhulia, J.—Heard Ms. Menka Tripathi, Advocate for the Petitioner and Mr. N.P. Sah, Standing Counsel for the State of Uttarakhand.

The Petitioner retired from the post of Health Officer (Male) from Primary Health Centre, Lamgara, Almora. He retired on 31.12.2000 after reaching the age of superannuation. The Petitioner has now filed a writ petition in the year 2007 claiming that he has not been given 10 per cent of his General Provident Fund (G.P.F.) as well as arrears of selection grade.

Regarding his arrears of selection grade, the Petitioner has failed to elaborate as to how the arrears of selection grade are due to him. Moreover, the fact that arrears of selection grade are due to the Petitioner have also been denied by the Respondents. The Respondents, however, admit that the Petitioner is liable to be given remaining 10 per cent of G.P.F. amount and the reason as to why the Petitioner has not been given the same is that the Respondents have written the authorities concerned, such as Accountant General, Uttarakhand, Dehradun, but no action has been taken in this matter.

As such, the Director General, Medical Health and Family Planning, Uttarakhand, Dehradun is directed to ensure the payment of remaining 10 per cent G.P.F. to the Petitioner within a period of 10 weeks from the date a certified copy of this order is produced before him. All necessary correspondences and efforts shall be made in this regard by the Director General, Medical Health and Family Planning, Uttarakhand, as the liability of such a payment has been admitted by the Respondents.

With the above observations writ petition is disposed of.
