On 15.09.2020 this Court passed the following order:

“CWP No.3668 of 2020 & CMP No.9109 of 2020.

Notice. Mr. Ranjan Sharma, learned Additional Advocate General, appears and waives service of notice on behalf of the respondents.

Learned counsel for the petitioner states that the issue in question is squarely covered by the judgment rendered by this Court in CWP

No.584 of 2020, titled Smt. Champa Devi versus State of Himachal Pradesh and others, decided on 13.07.2020 (Annexure PÂ7) and

another judgment rendered in CWP No. 3440 of 2020, titled Smt. Kalavatti Versus State of Himachal Pradesh and others, decided on

04.09.2020. Respondents to obtain instructions in this regard.

List on 29th September, 2020.â€​

Today, the learned Additional Advocate General has placed on record the instructions, relevant portion whereof reads as under:

“In this behalf, it is respectfully submitted that as per information received from Deputy Director of Higher Education, Shimla vide letter dated

5.10.2020 petitioner Smt. Muna Devi is similar situate to CWP No. 584 of 2020, titled Smt. Champa Devi Versus State of Himachal Pradesh and

others in which the services of petitioner Smt. Champa Devi has been regularised w.e.f. 5.11.2015 instead of 7.10.2016 in compliance to `judgment

dated 13.3.2020 passed in CWP No. 584/2020.â€​

Now, since the respondents themselves have considered that the case of the petitioner is similar to that of Champa Devi (supra), they are directed

to extend the same and similar benefit to the petitioner. However, as regards the monetary benefits, the same shall be confined to three years prior to

the filing of the writ petition.

The petition is disposed of in the aforesaid terms, so also the pending application(s) if any.

Authenticated copy of the judgment be supplied to the parties by the Court Master.
