Munshi Ram vs Gurdev Singh

This revision petition under Article 227 of the Constitution of India by the Petitioner-Defendant, Munshi Ram, is directed against the order dated 26.10.2010(Annexure P-1)passed by District Judge, Sirsa, vide which he dismissed the application filed by him u/s 24 CPC for the transfer of three civil suits from the Court of Shri Sudhir Parmar, Additional Civil Judge(Senior Division), Sirsa to any other Court.

The grievance of the Petitioner was against the said Presiding Officer and it was pleaded in the application that the Plaintiffs have been openly proclaiming that they have approached/made settlement with the Presiding Officer to get the case decided in their favour.

Such like allegations are not only unwarranted but contemptuous in nature. I do not find any illegality in the order passed by District Judge, Sirsa. However, in order to rule out the possibility of any apprehension on the part of the Petitioner and without touching the merits of the case, the said three civil suits titled as Gurdev Singh v. Munshi Ram, Iqbal Singh etc. v. Munshi Ram and Gurpet Singh etc. v. Munshi Ram, are ordered to be withdrawn from the Court of Shri Sudhir Parmar, Additional Civil Judge(Senior Division), Sirsa, and are transferred to the Court of Civil Judge(Senior Division) Sirsa, for deciding the same in accordance with law.

It appears that the intention of the Petitioner is to delay the decision of the civil suits and that is very much apparent from the impugned order. Therefore, Civil Judge(Senior Division), Sirsa, will decide these civil suits within a period not later than three months by taking the same on day to day basis.

Parties are to appear before Civil Judge(Senior Division), Sirsa, on 23.11.2010.

Civil Judge(Senior Division), Sirsa, shall be submitting the progress report to the District Judge, Sirsa, every fortnight.

Revision petition is disposed of accordingly.
