The appellant – accused No.2 has filed this appeal praying to set-aside the judgment of conviction and order of sentence passed in S.C.No.130/2012 dated 04.09.2014. The appellant – accused No.2 has been sentenced to pay fine of Rs.500/-, in default to undergo simple imprisonment for a period of fifteen days for the offence under Section 341 of IPC and sentenced to undergo rigorous imprisonment for a period of seven years and to pay fine of Rs.2,000/- for the offence under Section 395 of IPC. The sentence passed by the Trial Court has not been suspended in this appeal. This appeal came to be filed on 05.08.2015.

The letter dated 06.10.2023 has been received from the Chief Superintendent of Central Prison, Mysuru, wherein it is stated that this appellant – accused No.2 has completed his sentence passed in S.C.No.130/2012 by the III Additional District and Sessions Judge, Mandya sitting at Srirangapatna. In view of the appellant – accused No.2 completing his sentence, this appeal does not survive for consideration and the appeal is dismissed as having become infructuous.
