This is a repeat (fourth) application u/s. 439 of the Cr.P.C. For grant of temporary bail filed by the applicant who is in custody since 24.2.2021 in connection with Crime No.71/2021, registered at Police Station Barod, District Agar Malwa for the offences punishable under Sections 8/15, 23 of the NDPS Act.
The present application has been filed by the applicant for grant of temporary bail on account of death of his father 30.9.2023 and the last ceremony are scheduled on 9.10.2023, 10.10.2023 and 11.10.2023. There is no time left for verification of factum of death of applicant's father.
In view of the above, without commenting anything on the merits of the case, I am of the opinion that the applicant deserves to be released on temporary bail.
Accordingly, this M.Cr.C. is allowed. The applicant Nagudas S/o. Onkardas Bairagi is directed to be released on bail on his furnishing a personal bond in the sum of Rs.40,000/- (Rupees Forty thousand) with one solvent surety of the like amount to the satisfaction of the trial Court for a period of three days from the date of his release to attend the last ceremonies on account of death of his father. The applicant shall surrender immediately after expiry of three days before the concerned trial Court for sending him back to jail. Before the release of the applicant, the trial Court shall verify the factum of death and last ceremonies of father of the applicant from the local police station.
