The respondent No.4 is still not represented.
The petitioner has filed an application, being I.A. No. 1 of 2024, in which it is stated that on a query made to the Law & Parliamentary Affairs Department, Government of Sikkim, it was informed that the Sikkim Suraksha Samiti was not found registered in the Law Department. The petitioner further states that on inquiry made from the former members of the Sikkim Suraksha Samiti about the current address of the office of the respondent no.4, they were informed that the office had shut down and there was no current official address. The application is allowed.
The report is taken on record.
In such a view of the matter, the applicant prays that in terms of Order V Rule 20 of the Code of Civil Procedure, 1908, he may be permitted to effect substituted service.
The petitioner is allowed to effect substituted service upon the respondent no.4. Affidavit of service thereafter may be filed.
Learned counsel for the petitioner desires to file rejoinder to the counter-affidavits of state respondents and respondents no.5 to 7.
Considered. He is permitted to file within two weeks.
