Heard learned counsel for the petitioner. In this writ petition filed under Article 226 of the Constitution of India, the petitioner is seeking direction to the respondents to grant bonus marks for the questions which are asked out of syllabus and merit list may kindly be revised and if petitioner stands in merit after awarding bonus marks then he may be called for interview for the post of Sub-Inspector, Rajasthan Police.

After hearing learned counsel for the petitioner, I have perused the entire record of the case.

In my opinion, the establishment of RPSC is for the purpose of selecting suitable candidates for government service under provisions of the Constitution of India. Whether the questions put to the candidates are according to the syllabus or not, it is not for this Court to decide while exercising powers under Article 226 of the Constitution of India. The question papers are prepared by the expert body of RPSC and if petitioner is having any grievance, then he can file representation before the RPSC. This Court cannot sit as an appellate authority to decide the controversy with regard to grievances of the persons that questions are out of syllabus.

The contention of petitioner in this writ petition is for bonus marks for the questions which are put to the candidates out of syllabus.

Upon bare perusal of entire writ petition, it is no where pleaded by the petitioner how the questions are out of syllabus. The allegations of the petitioner that questions are out of syllabus is far from the truth, therefore, I am not inclined to interfere in this writ petition. The writ petition is hereby dismissed. However, petitioner will be at liberty to raise his grounds before the RPSC by way of filing representation and in that even it is expected from the RPSC that petitioner''s representation will be decided in accordance with law.
