K.C. Puri, J.—As per allegation of the prosecution, SHO, P.S. City Barnala received a secret information that Balbir Singh @ Madho s/o Chand Singh r/o PS Gamiwala Boha, Ranjit Singh s/o Baldev Singh r/o Bir Kalan, Jaswant Singh s/o Janger Singh r/o Dhapi, dismissed constable Chamkaur Singh r/o Pithohal, Mansa, who are in possession of car No. HR-51C-0418, are proclaimed offenders in many cases. They are accompanied by Naveen Kumar s/o Jai Pal Aggarwal - petitioner r/o Barnala, Balwinder Singh @ Binda Raiseria s/o Surjit Singh r/o Barnala. They are in possession of illegal weapons. At this juncture, they are sitting in a corner of an abandoned brick kiln on Sanghera Road, Barnala and they are plotting to carrying out incidents of looting and snatching. If a raid is carried out immediately, the above mentioned persons can be intercepted along with illegal weapons. The raid was conducted. Balbir Singh, Jaswant Singh and Ranjit Singh were arrested on the spot. One revolver and one pistol was also recovered from them.

As per prosecution, petitioner, Balwinder Singh and Chamkaur Singh, ran away from the spot.

The petitioner is seeking anticipatory bail in offence under Sections 399 and 402 IPC. The gravity of offence does not make out a case for grant of extra ordinary relief of anticipatory bail.

Learned Counsel for the petitioner has relied upon the authority reported as Jaswant Singh v. State of Haryana 2002 (1) RCR (Cri) 709.

The said authority relates to the regular bail and not the anticipatory bail.

So, the petition stands dismissed.
