16 paragraphs · 322 words[1] The applicant seeks extension of the interim bail granted to her husband, an accused in FIR Case No.57(9)2020 on the file of Nambol Police
Station, Bishnupur, registered under Sections 302 and 34 IPC.
[2] By order dated 11.12.2020 passed in Bail Appln.No.13 of 2020, this Court directed his release on interim bail for a period of four months, subject
to conditions, to enable him to get treatment for his ailment. Thereafter, by order dated 09.04.2021 passed in MC( Bail Appln.) No.2 of 2021, this
Court extended the bail granted to the applicant’s husband upto 10.05.2021. While so, the present bail application was filed stating that the
applicant’s husband is still undergoing medical treatment at the Regional Institute of Medical Sciences, Imphal, and requires to be granted further
extension of bail.
[3] Perusal of the material placed on record indicates that the applicant’s husband suffers from kidney stones (Nephrolithiasis). However, the
latest medical report filed with the present application reflects that he is presently suffering from depression and weakness. Mr. N.Ibotombi, learned
senior counsel, would inform this Court that he is yet to undergo the necessary treatment and surgery for his kidney condition. He would further state
that the other accused in the case, viz., the father and brother of the applicant’s husband, have already been enlarged on regular bail.
[4] Given the aforestated facts and the prevailing situation caused by the COVID-19 pandemic, this Court sees no purpose served in refusing
extension of bail to the applicant’s husband, who is medically and mentally unfit to be incarcerated at this stage. More so, as the other accused
have already been granted regular bail. This Court therefore directs extension of the interim bail granted to the applicant’s husband, N. Romesh
Singh, in relation to FIR Case No.57 (9) 2020 on the file of Nambol Police Station, Bishnupur, by a further period of one month, i.e., till 10.06.2021.
