Mohan Pyare, Member (A):

1.

Shri S.K. Kushwaha, learned counsel for the applicants and Shri Anil Kumar, learned counsel for the respondents are present.

2.

MA No.932 of 2025 has been filed by the applicants under Rule 4 (5) of CAT (Procedure) Rule, 1987, for permitting them to pursue this OA jointly. The cause of action and the relief sought by the applicants appear to be similar. Accordingly, MA No. 932/2025 is allowed. The applicants are permitted to pursue this matter jointly.

3.

Learned counsel for the applicants submits that their grievance shall be redressed if a direction is given to the respondents to consider and decide the pending representation dated 14.01.2025 (Annexure-A-13) of the applicants by passing a reasoned and speaking order within a time bound manner.

4.

Learned counsel for the respondents vehemently opposed the prayer of the applicant.

5.

However, in view of the limited prayer made by learned counsel for the applicants, no fruitful purpose will be served in keeping this O.A. pending. Accordingly, the competent authority amongst the respondents is directed to consider and decide the representation dated 14.01.2025 (Annexure-A-13) of the applicants along with any further representation submitted by applicants within 15 days from the order of this OA within a period of four months from the date of receipt of a certified copy of this order as well as further representation received. The competent authority is directed to give an opportunity of hearing to the private respondents also if they prefer to be heard by presenting written/oral representation, who are arrayed as private respondents in this OA. The order so passed shall be communicated to the applicant without any delay.

6.

It is made clear that this Tribunal has not expressed any opinion on the merits of the case.

7.

With the above direction, the OA is disposed of at the admission stage itself. No order as to costs.

8.

All MAs pending in this O.A. also stand disposed off.
