In the present OA, applicant has prayed for following relief and interim relief sought by the applicant:-
“8. Relief sought:
(a) Quash and set aside the impugned action/order of the respondents rejecting the applicant’s candidature reflected in their impugned
decision dated 27.10.2017 placed at Annexure A/1 where his particulars are at S. No. 32417, in view of the rejection of Respondent’s
SLP (C) No.31442/2018;
(b) Direct the respondents to restore the candidature of the applicant in the selection process of Combined Higher Secondary Level (10+2)
Examination-2016 and further consider the applicant case for appointment as per his merit position along with others.
(c) Accord all consequential benefits including monetary and seniority benefits.
(d) Award costs of the proceedings in favour of the applicant.
(e) Any other relief which this Hon’ble Tribunal deems fit and proper in favour of the applicant.
Interim relief:
Pending decision in OA, this Hon’ble Tribunal may graciously be pleased to direct the respondents to declare the result of the applicant
towards the typing test wherein the applicant has participated under the interim orders of this Hon’ble Tribunal passed on 27.11.2017
in the applicant’s previous OA being OA No. 4147/2017, by way of ex-parte ad-interim order.â€
Vide Order dated 04.11.2020, respondents were directed to produce the result of the applicant in a sealed cover in terms of directions of this
Tribunal’s contained in Order dated 27.11.2017 passed in previous OA No.4147/2017 filed by the applicant. In compliance of the said directions,
the respondents have submitted the result of the applicant in a sealed cover. With the assistance of the learned counsel for the respondents and of Mr.
R. Chakrapani, Under Secretary, SSC, we have perused the said result. It is found that the applicant has not been found successful in the said typing
test in which he participated in view of interim order dated 27.11.2017 of this Tribunal.
In view of the aforesaid, learned counsel for the applicant does not press the present OA. However, he seeks liberty to the applicant to agitate his
grievances in accordance with law, if occasion arises therefor and if so advised.
The present OA is accordingly dismissed with liberty to the applicant in accordance with law. The result so produced be returned to the
respondents through their counsel in a sealed cover.
