Parbhat Singh vs State of HB.P. and Another

Kurian Joseph, C.J.—The petitioner has approached this Court with certain grievances with regard to his seniority and consequential promotion. It is stated in para-3 of the reply, as follows:

In reply to this para it is submitted that the seniority list of Forest Guards in respect of Dharamshala Circle was circulated on 1.4.1993. According to this seniority list his name appeared on serial No. 88 and his date of appointment was shown as 13.1.1971. This list was circulated among the Forest Guards of the Circle. The applicant did not represent regarding the omission in the seniority list circulated. He represented only during the year September 1999 only after the period of more than six years when he was going to be retired. After considering his representation, his date of appointment in the department was confirmed as on 14.1.1970 which was inadvertently shown in the seniority list as 13.1.1971. Therefore, his case is being considered in the light of his revised seniority which has resulted due to the change of date of appointment.

In view of the stand taken in the reply that the case is being considered, the writ petition is disposed of making it clear that in case the consequential benefits have not been granted to the petitioner, the same shall be granted within a period of two months from the date of production of copy of this Judgment and a copy of this petition by the petitioner.

With the above observations, the writ petition stands disposed of so also the pending application(s), if any.
