Paresh Nath Bid and Others vs State of Jharkhand and Others

Prashant Kumar, J.—This application has been filed commanding the respondents to consider the case of the petitioners for promotion from the post of Lecturer to the post of Reader, as per Statutes of the Ranchi University. It is submitted that petitioners were appointed as Lecturer in P.P.K. College, Bundu. Later on, the said college has become constituent and the cases of absorption of these petitioners were considered by Justice S.C. Agrawal Commission. It is further submitted that as per the recommendation of Hon''ble Agrawal Commission, petitioners were permanently absorbed on the post of Lecturer with effect from the dates mentioned against their names in Annexure-5. Thus, from the date of their absorption on the regular post, they have already completed 10(ten) years of service. It is submitted that after completion of 10 years of service, as per Statutes dated 24.12.1986, petitioners are entitled to be considered for promotion to the post of Reader.

On the other hand, Mr. A.K. Mehta, learned counsel appearing for the Ranchi University submits that petitioner Nos. 1 to 4 have already been superannuated, but before superannuation, they have not filed any application before the University for being considered for promotion to the post of Reader. It is further submitted that even petitioner No. 5 has not made any application for promotion.

Under the aforesaid fact and circumstance, I direct the petitioner to file application in the prescribed form before the University for being considered for promotion to the post of Reader as per Statutes. I further direct the University to consider the application of the petitioners as per Statutes and various circulars, guidelines, instructions, directions issued by the State Government and if it is found that petitioners are eligible for promotion to the post of Reader, their case be recommended to the Jharkhand Public Service Commission. The Jharkhand Public Service Commission is directed to consider the case of the petitioners and if it is found that petitioners are eligible for promotion to the post of Reader, then the Commission shall grant occurrence. With the aforesaid observations and directions, this writ application is disposed of.
