Petitioners have filed this petition under Section 438 Code of Criminal Procedure for grant of anticipatory bail in complaint case No.2449 of 2018,
registered on 10.12.2018, under Sections 307, 326, 450, 120-B and 506 IPC, 1860 and Sections 25/27 Arms Act, 1959 (but the petitioners have been
summoned only under Sections 307, 450, 506 read with Section 34 IPC, 1860 and Section 25 Arms Act, 1959) pending before the Court of Ld. Addl.
Chief Judicial Magistrate, Faridkot, District Faridkot. On 29.10.2019, the following order was passed by the Court:
“Learned counsel for the petitioners relies upon the order dated 04.10.2019 (Annexure P-8) passed by this Court in CRM-M-42682-2019.
Notice of motion for 03.02.2020.
The petitioners shall appear before the learned trial Court on or before the date fixed i.e. 23.11.2019 and upon their appearance, the Magistrate shall
admit them on interim regular bail on their furnishing requisite bail bonds and surety bonds to the satisfaction of that Court.
To be heard along with CRM-M-42682-2019.â€
Learned counsel for the petitioners submits that in compliance of the order dated 29.10.2019, the petitioners submitted themselves before the Court on
21.11.2019, who have been released on interim regular bail upon furnishing the requisite bail bonds and surety bonds.
On the other hand, learned State counsel on instructions from ASI Bhupinder Singh does not dispute this fact that the petitioners submitted themselves
before the trial Court on 21.11.2019 and furnished the bail bonds and surety bonds.
Considering the above, the petition is allowed and the petitioners are allowed to remain on the same bail bonds and surety bonds furnished by them
before the trial Court on 21.11.2019.
