The challenge in this petition is made to the proceedings of Case No.125 of 2020, State vs. Pramod Parmar and others, under Sections 323, 498-A, 504, 506 IPC and Sections 3/4 of the Dowry Prohibition Act, 1961, pending in the court of Judicial Magistrate, Doiwala, District Dehradun (for short, “the case”) on the basis of amicable settlement between the parties.
Parties have also filed a joint compounding application along with the affidavits of the petitioners and the respondent no.2.
Heard learned counsel for the parties and perused the record.
Learned counsel for the parties would submit that the parties have settled the dispute amicably.
The petitioners as well as the respondent no.2, the informant have joined the proceeding through video conferencing, as identified by their respective counsel. They have accepted the compromise. The respondent no.2 would submit that since, they have some intellectual disputes, therefore, they have decided to stay separate.
It is a dispute arises out of matrimonial discord. Since, the parties have settled the dispute amicably, therefore, the petition is disposed of on the basis of amicable settlement between the parties. The proceedings of the case, is hereby quashed.
Compounding application stands disposed of accordingly.
