This is a bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Narsinghpur PS Case No.100 of 2019 corresponding to CT Case No.161(A) of 2019 pending in the file of learned JMFC, Narasinghpur for commission of offences punishable U/Ss.147/148/323/307/302/506 r/w Section 149 of the IPC.
The allegation against the Petitioner in gist is that on 04.08.2019 at about 8PM, while the informant and others had stood on the ridge of the river, the present Petitioner and others being armed with deadly weapons like sword, axe, thenga, barchha, bow, arrow and farsa attacked the informant's party, but due to shooting of arrow, one Sridhar Samal died and due to assault of the assailants, other persons suffered injuries. On this incident, FIR was lodged and charge sheet was submitted against the Petitioner and others for offence U/Ss. 307/302 of IPC along with other offences by showing the Petitioner as an absconder.
Heard, Mr. Jnyanananda Panda, learned counsel for the Petitioner appearing virtually and Mr. M.R. Patra, learned Addl. PP in the matter and perused the record.
Admittedly, the case was registered in the year 2019, but the Petitioner was arrested just few days before on 15.04.2026. One of the important considerations in granting bail is securing attendance of the accused at the trial, but conduct of the Petitioner in avoiding the process of law for around more than six years itself speaks in volume against him. In the aforesaid situation and circumstances, especially when a person had died and many others sustained injuries and the Petitioner being named in the FIR and he having been shown as an absconder in the charge sheet, this Court is not inclined to grant bail to the Petitioner at this stage.
Hence, the bail application of the petitioner stands rejected. Accordingly, the BLAPL stands disposed of. A soft copy of this order be immediately transmitted to the learned trial Court.
