Judgment

The wife in the MC proceedings has approached this court in this writ petition. She has obtained an order of maintenance against her husband as early as on 21/11/2013. The learned counsel for the petitioner submits that now a total sum of more than ₹15,00,000/- is due as arrears of maintenance from the 4th respondent. Already, warrant has been issued by the learned Magistrate to enforce the order. The grievance of the petitioner is that the 2nd respondent is not taking any steps to execute the warrant of arrest.
I have heard Sri.K.R.Vinod, the learned counsel for the petitioner.
The documents on record would show that even though an order of maintenance was passed and warrant was issued to enforce the same, it is not being executed so far. Distress warrant was also issued. The 3rd respondent, District collector is the person to execute it. More than ₹15,00,000/- is in arrears. Hence, this writ petition is disposed of, with a direction to the 2nd and 3rd respondents to enforce Exts.P2 and P4 without further delay.
