Judgment
Sanjeev Sachdeva, J
Petitioner seeks anticipatory bail in FIR No. 442/2017 under Section 376/354-D/506 of the IPC, Police Station Mansarovar Park.
By order dated 26.02.2018, petitioner was granted interim protection subject to petitioner's joining investigation.
Learned Addl. PP, under instructions from the IO informs that chargesheet has been filed. He submits that since the petitioner was granted interim protection, chargesheet has been filed without arrest.
Learned senior counsel for the petitioner under instructions submits that since the charge sheet has been filed, the petitioner shall approach the trial court for grant of bail.
Accordingly, the petitioner is permitted to file an application before the trial court within a period of one week from today.
On petitioner filing an application seeking bail within one week, the interim protection granted to petitioner by order dated 26.02.2018 shall continue to enure to his benefit till disposal of the said application. In case the application filed by the petitioner before the trial court is rejected, the interim protection shall continue for a period of one week thereafter.
Petition is disposed of in the above terms.
