This is the bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Bologarh PS Case No.110 of 2023 corresponding to GR Case No.357 of 2026 pending in the file of learned JMFC(City), Khurda for commission of offences punishable U/Ss.109/115(2)/296/351(2) of IPC, on the main allegation of attempting to the life of his mother by assaulting her.
Heard, Mr. Santosh Sethi, learned counsel for the petitioner and Mr. P.Satapathy, learned Additional Public Prosecutor in the matter and perused the record.
After having considered the rival submissions upon perusal of record, there appears not only allegation against the petitioner for attempting to the life of his mother by assaulting her, but also there is previous allegation against him for assaulting his father. Besides, the petitioner is implicated in another case which is evident from the impugned rejection order, but the petitioner has not disclosed his criminal antecedent in his bail application. In the context of suppressing materials facts, this Court is fortified with the decision in Munnesh Vrs. State of Uttar Pradesh; 2025 SCC OnLine SC 1319, wherein the Apex Court at paragraph-9 has held as under:-
“9.Xxx xxx xxx, since the petitioner has suppressed material facts with regard to his involvement in criminal cases, he is not entitled to the discretionary relief of bail. Xxx xxx xxx”.
In view of the aforesaid facts and circumstance and taking into account the conduct of the petitioner in suppressing facts and considering the cumulative alleged action of the petitioner in assaulting his father and mother on two separate occasions, this Court is not inclined to grant bail to the petitioner at this stage.
Hence, the bail application of the petitioner stands rejected. Accordingly, the BLAPL stands disposed of. A copy of this order be immediately transmitted to the learned Court in seisin over the matter.
