Though this revision petition is filed in the year 2019, the counsel for the petitioner is not pursuing the matter.
This Court vide order dated 25.01.2019, issued emergent notice to the respondent and when the matter was listed on 15.10.2019, there was no representation and adjourned on 16.10.2019. On 16.10.2019, this Court condoned the delay and suspended the sentence subject to deposit of 50% of the compensation amount inclusive of amount which has already been deposited with a personal bond of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the Trial Court. The said conditional order was not complied with. When the matter was listed on 12.01.2021, 19.02.2021, 19.04.2021, 24.05.2021, 07.06.2021, 14.06.2021, 27.07.2021, 04.08.2021, 16.09.2021, 25.01.2022 and 09.02.2022, the counsel for the petitioner was absent and it is clear that the counsel for the petitioner is not interested in pursuing the matter and first of all, the interim order is also not complied with. As there are concurrent findings by the Trial Court as well as the Appellate Court and this matter is not admitted and when the counsel for the petitioner is not pursuing the matter diligently, the revision petition is dismissed for non-prosecution.
