Radha Govind vs Vinoba Bhave University and Another

Poonam Srivastav, J.—The instant writ petition is preferred for grant of affiliation on a permanent basis to the Petitioner college for M.Ed. Course for the session 2010-11 immediately as the Petitioner college has already been granted recognition by the National Council for Teachers'' Education, Eastern Regional Committee, Bhubneshwar.

The matter of affiliation is pending since a very long time but the Respondent University has been sitting tight over the matter without any serious effort to pass the order of affiliation. Career of students will be jeopardized only because of inaction on the part of the Respondent University.

Previously a Devision Bench in L.P.A. No. 372 of 2010 had issued a direction to the Respondents to grant affiliation for the session 2009-10 within two weeks and a direction was given that affiliation will not be refused on technicalities.

Pursuant to the said order, the students were permitted to participate in the examination and the Respondent University has not yet proceeded to grant the affiliation. The students for the session 2010-11 of M.Ed. Course are preparing for the examination scheduled to commence on 17th of August, 2011. Request is for permission for grant of affiliation to the Petitioner college for the session 2010-11 and thereby the students may be permitted to participate in the examination which is to commence from 17th of August, 2011.

The counsel appearing on behalf of the Respondent University has prayed for some time till 17.08.2011.

List this writ petition on 24.08.2011. By that date, it is directed that the permanent affiliation shall be granted by the Respondent University else the Registrar, Vinoba Bhave University shall be present in Court on that date in person to explain the situation.

Provisional affiliation shall be granted forthwith for the session 2010-11 to enable the students to participate in the examination. The students shall be permitted to sit for the examination without any objection.
