This is seventh application filed under section 483 of the BNSS, 2023 for grant of temporary bail in connection with Crime No.119/2024 registered at Police Station -Namli, District - Ratlam(M.P.) for offence punishable under Sections 302, 201, 120-B and 34 of IPC. He is in custody since 25.03.2024. Applicant's first, third and fifth bail applications were dismissed as withdrawn v i d e orders dated 01.05.2024, 05.08.2024 & 10.09.2025 passed in M.Cr.C. No. 16166/2024, M.Cr.C. No. 28388/2024 & M.Cr.C. No. 26309/2025. His second, fourth and sixth bail application were dismissed on merits v i d e orders dated 27.05.2024, 27.02.2025 and 29.10.2025 passed in M.Cr.C. No. 20606/2024, M.Cr.C. No. 7766/2025 and M.Cr.C. No. 46105/2025.

Learned counsel for the applicant submits that the present seventh application for grant of temporary bail to the applicant has been filed on the ground of serious ailment of applicant's wife - Mitthu Jaat.

Learned Counsel for State referred to the verification report from the SHO, P.S. Namli Distt. Ratlam verifying the factum of medical status/ailment of applicant's wife.

The medical report, received from the Dr. Aakash Choudhary, PGMO (Medicine), District Hospital, Mandsaur dated 24.03.2026 in compliance with Court order dated 20.03.2026, is as under :-

(i) Patient is suffering from Pelvic Inflammatory Disease(USG ASolomen) & Cervicitis(PapSmear). It may spread if not treated or biopsy done on time.

(ii) Cervical Biopsy may be needed because patient symptoms not relieved by treatment multiple times.

(iii) As per Gynaecologist opinion hence referred to Higher Centre.

Heard learned counsel for the parties and perused the medical report received from the P.S. Namli, Ratlam.

Considering the medical report, the request for temporary bail is allowed on humanitarian grounds to facilitate medical assistance and proper treatment to the applicant's wife - Mitthu Jaat and considering the gravity of alleged offence, it is directed that the applicant shall be released on temporary bail for a period of 01 month (One month) from the date of his release on bail for treatment of his wife as "an inhouse patient at any Medical Centre or Nursing Home", subject to deposit of cash amount of Rs.1,00,000/- in the trial Court and on his furnishing personal bond of Rs.2,00,000/- (Rupees Two lakhs only) with one surety of the like amount to the satisfaction of the trial Court for compliance with following conditions-

Applicant shall admit his wife for treatment at any higher Medical centre having facility of requisite treatment within three days of his release on bail and submit copy of medical status and treatment papers of his wife, as inhouse patient, on Monday of every week before the trial Court.

If his wife Mitthu Jaat is discharged from Medical Centre/ Nursing Home before expiry of one month, applicant shall immediately surrender to custody of concerned Court/ Superintendent of concerned Jail.

The applicant shall abide by the conditions enumerated u/S 437(3) of Cr.P.C. during period of bail.

In case of failure to comply the order within 07 days or violation of any condition of bail, this temporary bail order shall automatically stand cancelled and the cash amount and the bonds shall be forfeited.

The applicant shall surrender before the trial Court on or before expiry of period of 01 month (One month) . The cash amount be returned to the applicant on surrender, else it will be forfeited. Necessary papers regarding surrender and treatment of the wife of applicant be furnished to the registry of this Court also.

M.Cr.C. stands disposed of accordingly.
