Judgment
Petitioner took a loan of Rs.3.92 lakh (Rupees Three Lakh & Ninety Two Thousand Only) from Almora Kshetriya Gramin Bank (now
Uttarakhand Gramin Bank) in the year 2007. According to the petitioner, he has paid the entire loan in the year 2009, however, Bank is not issuing
No Dues Certificate"" to the petitioner. Learned counsel for the petitioner submits that in the Khata Khautani of the petitioner, in respect of his
agricultural land, the charge on petitioner''s property is being disclosed, which is causing hardship to him, as he is unable to take loan and other
facilities against it.
On the other hand, Mr. K.K. Shah, learned counsel for the Bank submits that petitioner is yet to liquidate the loan and there are certain dues
which are still outstanding against him.
Learned counsel for the petitioner confines his prayer and submits that petitioner may be permitted to approach the Competent
Authority/Branch Manager of the concerned Bank and the Competent Authority may be directed to examine the matter and take appropriate
decision.
Mr. K.K. Shah, learned counsel for the Bank submits that if petitioner makes a fresh representation to the Branch Manager/Authorised Officer
of the Bank, the Bank shall look into the matter and take a decision in the matter sympathetically.
Accordingly, the writ petition is disposed of with liberty to petitioner to make a fresh representation to the Branch Manager of the Bank within
ten days from today. If such representation is made, Branch Manager/Authorized Officer shall look into the matter and take appropriate decision,
in accordance with law, within four weeks thereafter.
