Petitioner is an Advertiser. According to the petitioner, he was granted a contract for collection of advertisement fee in the year 2014-15 by Nagar

Nigam Rudrapur, as his bid of Rs. 7,00,786/- was found to be the highest. Since petitioner had deposited a sum of Rs. 6,00,786/- only, therefore, Nagar

Nigam, Rudrapur issued a demand notice dated 29.05.2018, requiring the petitioner to deposit the remaining amount of Rs. 1,00,000/-. The said

demand notice has been put to challenge in the present writ petition.

Since petitioner had offered to pay Rs. 7,00,786/- for award of the contract and his bid was accepted, as his bid was found to be the highest,

therefore, he is liable to pay the entire amount offered by him in his bid.

Since petitioner had not deposited the entire amount, therefore, the Nagar Nigam, Rudrapur was justified in asking the petitioner to deposit the

remaining amount.

In such view of the matter, this Court does not find any infirmity in the impugned notice, which may warrant interference by this Court under

Article 226 of Constitution of India.

Accordingly, the writ petition fails and is dismissed.
