Petitioner seeks anticipatory bail in FIR No.152/2018 under Sections 420/467/468/471/120B IPC, Police Station Anand Vihar.

Subject FIR was registered on a complaint made by the complaint contending that the Agreement to Sell had been forged by the petitioner. Further, based on the Agreement to Sell, a suit for specific performance was filed by the wife of the petitioner. Petitioner is a witness to the said document.

Pending the present proceedings, mediation took place between the parties. Consequent to which, wife of the petitioner has withdrawn the suit filed by her seeking specific performance based on the said Agreement to Sell.

Learned counsel for the parties further submit that they are still in negotiation exploring the possibility of a settlement.

Petitioner was granted interim protection by order dated 06.07.2018, subject to joining investigation.

Learned APP for the State, under instructions from the Investigating Officer, confirms that the petitioner had joined investigation as and when was so required by the Investigating Officer.

Without commenting on the merits of the case and keeping in view of the above, it is directed that in event of arrest, the arresting officer/IO/SHO shall release the petitioner on bail on his furnishing a bail bond in the sum of Rs. 15,000/- with one surety of the like amount to the satisfaction of the arresting officer/Investigating Officer/SHO concerned. Petitioner shall not do anything that may prejudice the investigation, trial or the prosecution witnesses.Petitioner shall join investigation as and when so required by the Investigating Officer.

The petition is allowed in the above terms.
