Rajeev Thakur vs State of H.P and Others

Kurian Joseph, C.J.—Writ petition is filed mainly with the following prayers:

a) A writ in the nature of certiorari may be issued and thereby quash the order of transfer dated 29.4.2011 Annexure P-1.

b) A writ in the nature of mandamus may be issued and thereby directing the Respondent No. 3 to allow the Petitioner to work in Govt. High School Udaipur Distt. Chamba and the Respondent No. 2 may kindly be directed to transfer the Respondent No. 4 in the vacant station or in alternative the Petitioner may kindly be adjusted near Chamba so that any member of the family can look after the Petitioner.

Among other contentions, it is mainly contended that the Petitioner is physically disabled to the extent of 60% and in terms of the Policy, he is to be accommodated in a place of his choice. The Petitioner may file an appropriate representation pointing out all his grievances and also places where he could be accommodated in terms of the Policy. In the event of such representation being received by the second Respondent within a week from today, appropriate orders in that regard will be passed within another 10 days. In case the Petitioner is relieved, in the meanwhile, he may not be compelled to join the transferred station and it will be open to him to avail leave of the kind due.

With the above directions, the writ petition stands disposed of, so also the pending application(s), if any.
