The petitioner has filed the instant petition under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of CERTIORARI for setting aside the letter Memo No. ECA-2-2022/112261-72 dated 21.09.2022 qua village Chhajpur Khurd, Block Sanoli Khurd, District Panipat (Annexure P-2) being illegal and violative of Articles 14, 15 and 243-D of the Constitution of India and directing the respondents to decide the application of the petitioner dated 27.09.2022 (Annexure P-3).

Learned counsel for the petitioner submits that he will be satisfied in case the directions are issued to the respondents, especially, respondent No. 4-Director General, Development and Panchayat Department, Haryana to decide the representation (Annexure P-3) of the petitioner in a time bound manner, at this stage.

At this stage, Mr. P.P. Chahar, DAG, Haryana accepts notice on behalf of the respondents and on instructions from Sh. Ranveer Singh Sodhi, Deputy Director (Legal) Development and Panchayat Department submits that petitioner may be directed to appear before respondent No. 4-Director General, Development and Panchayat Department, Haryana and undertakes that the representation (Annexure P-3) submitted by the petitioner shall be considered immediately by the respondent No. 4 by passing a speaking order in the light of relevant provisions of the Articles 14, 15 and 243-D of the Constitution of India.

In view of the statements made by the learned counsel for the petitioner as well as learned State counsel, we direct the respondent No. 4 to decide the representation of the petitioner (Annexure P-3) by tomorrow itself.

The petitioner shall appear before the concerned authority at 10.30 a.m. on 07.10.2022.

The respondent No. 4 shall also supply a certified copy of the order so passed by him to the applicant/petitioner on the same day.

Disposed off accordingly.
