This application under Section 482 Cr.P.C. has been filed by the petitioner challenging the order dated 15.12.2022 passed in Cr.P. No.118 of 2018 by the learned Judge, Family Court, Baripada allowing the application of the opposite party filed under Section 125 Cr.P.C., directing for payment of Rs.3,000/- per month to the opposite party-wife with effect from January, 2019. By the said order, the learned Judge, Family Court, Baripada has directed for payment of current monthly maintenance from the month of December, 2022 and for payment of arrear maintenance amount till November, 2022 in 08 equal installments.

Issue notice to the sole opposite party in the RPFAM and in the I.A., by registered post with A.D., requisites for which shall be filed by 16.09.2023. The notice shall be made returnable within four weeks. Accept one set of process fee.

List this matter on 08.11.2023.

Without prejudice to the contentions of the learned counsel for the petitioner, the petitioner is directed to deposit an amount of Rs.10,000/- (Rupees ten thousand) before the learned Judge, Family Court, Baripada by 27.09.2023. The said amount shall be released in favour of the opposite party-wife.

Urgent certified copy of this order be granted as per rules.
