Petitioners are seeking direction to the respondents to treat them as eligible for registration/enrollment in Doctor of Philosophy (Ph.D.) and allow them to submit their applications.

Vide notification dated 05.05.2016 (Annexure P-6), issued by the University Grants Commission (UGC), for admission to Ph.D programme, eligibility criteria for admission to Ph.D. programme has been given in Rule 3.2, which is reproduced as under:-

"3.2. Candidates who have cleared the M.Phil. course work with at least 55% marks in aggregate or its equivalent grade 'B' in the UGC 7-point scale (or qn equivalent gorade in a point scale wherever grading system is followed) and successfully completing the M.Phil. Degree shall be eligible to proceed to do research work leading to the Ph.D. degree in the same Institution in an integrated programme. A relaxation of 5% of marks, from 55% to 50%, or an equivalent relaxation of grade, may be allowed for those belonging to SC/ST/OBC (non-cremy layer)/differently-abled and other categories of candidates as per the decision of the Commission from time to time."

The petitioners being candidates in the SC category, are entitled to 5% relaxation from 55%, which is the eligibility for the candidate of General category. 5% relexation makes the eligibility to 50.25%. The petitioners have got 50% in his Masters of Ancient Indian History Cultural Arcology. They have not got 52.25% marks and hence, as per notification dated05.05.2016 (Annexure P-6) issued by the UGC, they are not eligible for admission.

No case for interference is made out.
