The grievance of the petitioner seems to be  inaction on the part of the respondent­ authority in not granting joining to the petitioner on the post of Constable (G.D.), District Mungeli. The petitioner had initially applied for the post of Constable (G.D.) and he got selected and the select list was published on 01.03.2021. Subsequently, the respondent i.e. the office of respondent No.3 has issued a call letter to the petitioner for reporting on the duty within a period of seven days failing which his name shall be struck from the select list. The petitioner in spite of having received the call letter dated 08.06.2021 did not give his joining within the period of seven days time that was required. On the contrary he moved a representation to respondent No.3 highlighting the fact that he is facing the criminal case and there is compromise proceeding in the same has already in process and he be permitted to join immediately after he be discharged from the criminal case pending against him. Subsequently, criminal case has resulted in his acquittal by way of compromise that was struck between the petitioner and the complainant, the said order has been passed by the Special Judge, SC & ST (PA) Act, 1989 on 17.11.2021 and, thereafter, the petitioner has approached the respondents but he has not been given joining nor they had taken decision on his application.

Learned State counsel would submit that let the petitioner make fresh representation to the respondents and the same shall be considered and decided by the respondents strictly in accordance with the rules and regulations governing the field.

As submitted by learned counsel for the parties, as of now, the instant writ petition stands disposed off. Let the petitioner make fresh representation before respondent No.3 within ten days from today, in addition to all representations that he was made in the past, and, in turn, within a period of 45 days from the date of receipt of copy of this order respondent No.3 shall examine and take appropriate decision on the petitioner's representation on its own merits and in accordance with law.
