The petitioner seeks interim bail for a period of two months in FIR No. 18/2014 under Sections 21/25/29/62/85 of the NDPS Act read with Sections
468/471/34 of the IPC, Police Station Special Cell, Sector-6, Rohini, Delhi, on the ground that the wife of the petitioner requires urgent surgery.
The status report has been filed. The same is taken on record. As per the status report, the factum of operation is confirmed. Medical documents
have been verified. The Doctor has advised surgery of the right thigh nail removal and remodelling with bone grafting. As per the medical report, the
wife of the petitioner is to be operated on 16.08.2018. Doctor has opined that the patient would require approximately four months to recover.
Learned counsel for the petitioner points out that the petitioner has earlier also been released on interim bail, though on different grounds. Learned
counsel submits that the petitioner duly complied with the orders granting interim bail and surrendered in terms of the said orders.
Keeping in view the facts and circumstances, the petitioner is directed to be released on interim bail for a period of two months. The petitioner shall
furnish a personal bond in the sum of Rs.75,000/- with one surety of the like amount to the satisfaction of the Trial Court. On expiry of the period of
two months from the date of his release, he shall surrender before the concerned Superintendent (Jail). The petitioner shall not do anything which may
prejudice either the trial or the prosecution witnesses. The petitioner shall also not leave the country without the permission of the Trial Court.
The petition is allowed in terms of above.
