"We are of the view that this is a matter where the High Court should have interfered and remanded the case to the Director of Consolidation for considering the application of the Petitioners on merits with a view to ensuring that the consolidation of holdings took place in a manner which will be fair and just to the Petitioners. Mr. Goburdhan, learned advocate for the first Respondent, also agrees that the matter should be remanded so that fair and just con-solidation of holdings may be made. We therefore allow the appeal, set aside the judgment of the High Court as also the order of the Director of Consolidation and remand the matter back to the Director of Consolidation with a direction to dispose of the application of the Petitioners on merits in accordance with law Since the matter is an old one, we would direct that the Director of Consolidation shall dispose of the matter at a very early date, as far as possible within three months from today, after hearing the Petitioners and other affected parties."

AND this Court DOTH FURTHER ORDER that this Order be punctually observed and carried into execution by all concerned.
