The present writ petition has been filed seeking directions for quashing of the Show Cause Notice dated 18th September, 2025 passed by the respondent-Municipal Corporation of Delhi (“MCD”) with respect to the second, third and fourth floors of the property bearing No. 10917 (Part), Manakpura, Karol Bagh, New Delhi-110005.

Learned counsel appearing for the petitioner submits that an appeal has already been filed on behalf of the petitioner before the Appellate Tribunal, MCD (“ATMCD”), which is next listed for hearing on 13th

He submits that the present writ petition was filed since earlier there was no Presiding Officer in the ATMCD. However, since there is now a Presiding Officer in the ATMCD, he shall press his appeal in the said forum. However, he submits that limited protection may be granted to him till matter is heard before the ATMCD.

Responding to the present writ petition, learned counsel appearing for the respondent- MCD submits that requisite action has been taken by the MCD after following due procedure and in accordance with law.

This Court is informed that there is already a Presiding Officer in the ATMCD now.

Accordingly, considering the facts and submissions made before this Court, and since the appeal of the petitioner could not be heard on 25th September, 2025, as there was no Presiding Officer in the ATMCD at that point of time, it is directed that till the next date of hearing before the ATMCD, i.e., 13th November, 2025, no coercive action shall be taken against the property of the petitioner.

It is clarified that this Court has not expressed any opinion on the merits of the case, which shall be considered by the ATMCD.

Rights and contentions of the parties are left open.

With the aforesaid directions the present petition, along with the pending applications, stands disposed of.
