Judgment

On the allegations of committing murder of Sh. Kartar Singh, aged 22 years, who was a mentally challenged person, in furtherance of sharing common intention with five more accused, the petitioner, who is under arrest, on being arraigned as accused in FIR No. 56 of 2019 dated 29.3.2019, registered under Sections 302, 201, 109, 111, 34 of the Indian Penal Code, 1860, in Police Station, Joginder Nagar, District Mandi, H.P. disclosing non-bailable offences, has come up before this Court under Section 439 Cr.P.C., seeking regular bail.
While issuing notices to the State, the Court had requested Mr. Nand Lal Thakur, learned Additional Advocate General to procure status report either through WhatsApp/e-mail and forward the same to this Court on e-mail id hicourt-hp@nic.in and also send the scanned copy or PDF copy of the status report to the learned Counsel for the petitioner on his WhatsApp number.
Mr. Nand Lal Thakur, learned Additional Advocate General has filed the status report through e-mail, printout whereof has been placed on record. He further submit that he has sent a copy of the status report to learned Counsel for the petitioner on his WhatsApp number.
I have read the status report(s) and heard learned counsel for the parties.
The nature of order, the Court proposes to pass needs no adjudication on the merits of the case. Suffice it to say that keeping in view the fact that the petitioner had lost his young son, aged 22 years and also keeping in view the fact that his father is 87 years old and they need some solace because of his presence in the house, this petition is disposed of by giving limited bail of four weeks to the petitioner on furnishing personal bond in the sum of Rs. 10,000/- with one surety in the like amount to the satisfaction of Illaqua Magistrate/Trial Court. It is clarified that the copy downloaded from the site of High Court and authenticated by the Advocate would be sufficient. It is further clarified that the petitioner shall surrender the jail on 20.7.2020 at 5:00 p.m. which releases him, and failure to do so shall be taken very strictly against the petitioner. All pending application(s), if any, also stand disposed of.
Authenticated copy in case the counsel for the petitioner and the State ask for the same.
