Judgment
This Criminal Petition, under Section 438 of the Code of Criminal Procedure 1973, is filed by the petitioner/A-2 seeking to grant anticipatory bail in
the event of her arrest in connection with Crime No.424 of 2021 of Kushaiguda Police Station, Rachakonda Commissionerate, which was registered
for the offence punishable under Section 304-B r/w.34 of IPC.
Heard learned counsel appearing for the petitioner/A-2, learned Additional Public Prosecutor appearing for the respondent-State and perused the
record.
As seen from the contents of the FIR itself, the marriage of the deceased with accused No.1 was performed on 05.08.2020 and the deceased
found dead in the house of her in-laws on 22.06.2021 just within one year of her marriage in un-natural circumstances. The grave allegations against
the petitioner/A-2 are that she along with other accused, harassed the deceased both physically and mentally for additional dowry and in this regard,
several panchayats were held before the elders.
Learned counsel for the petitioner/A-2 would submit that the petitioner/A-2 was falsely implicated in this case and she has no role with the alleged
offences and further submits that the petitioner/A-2 is ready to abide by any conditions that may be imposed by this Court in the event of granting
anticipatory bail to her.
Learned Additional Public Prosecutor has vehemently opposed to grant bail to the petitioner/A-2.
Thus, looking into the nature of allegations levelled against the petitioner/A-2 and looking into the gravity of the offence, I am not inclined to release
the petitioner/A-2 on anticipatory bail and accordingly, the prayer for anticipatory bail of the petitioner/A-2 is rejected.
Accordingly, the Criminal Petition is dismissed. However, the petitioner/A-2 is directed to surrender before the Court concerned within fifteen (15)
days from today, failing which the Police shall take coercive measures against the petitioner/A-2.
Miscellaneous petitions pending, if any, in this Criminal Petition, shall stand closed.
