Having taken note of the fact that the petitioner has already completed her normal tenure of posting at Civil Hospital Dehar, District Mandi, there appears to be no justification for this Court to interfere with impugned transfer order, dated 25.9.2023, Annexure P-1,whereby petitioner has been ordered to be transferred from Civil Hospital Dehar District Mandi to TBS Dharampur, however, having taken note of the fact that the petitioner’s husband is posted in the office of Deputy Commissioner Bilaspur, this court deems it fit to dispose of the present petition with liberty to the petitioner to file a representation to the competent authority, within one week from today, praying therein for her adjustment at Biaspur or nearby station or cancellation of transfer, which, in turn, shall be decided by the competent authority expeditiously, preferably within a period of six weeks, strictly in terms of Comprehensive Guiding Principles/Transfer Policy, wherein admittedly a provision has been made to post couples at nearby/adjacent places. Needless to say, competent authority, while doing the needful, in terms of this order, shall afford opportunity of hearing to the petitioner and pass a speaking order thereafter. Liberty is reserved to the petitioner to file appropriate proceedings, before appropriate court of law, if she still remains aggrieved. Till the time representation, if filed by the petitioner within one week from today, is decided by the competent authority within the time stipulated by this court, operation and implementation of order dated 25.9.2203, Annexure P-1 shall remain stayed.

Petition stands disposed of in the afore terms, alongwith all pending applications.
